====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 22-06-2020 Due to COVID-19 Pandemic, the matter is being taken up by way of virtual Court proceeding.

The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsels for the parties.

The following reliefs have been sought for on behalf of the petitioner in the present writ application. "For issuance of a writ of Mandamus directing the respondent authorities to grant and pay the arrears of family pension as well as current pension amount to the petitioner on the ground that her husband Late Pannong Bhushan Tiwary died in harness on 15.05.2000

A counter affidavit has been filed on behalf of the respondent no. 3 i.e., the Accountant General, Bihar, Patna. The following statement has been made in paragraph no. 11 of the said counter affidavit.

" That it is humbly submitted that the D.D.C., Patna, vide Letter No. 123 dated 20.01.2020, has sent the pension papers alongwith the Service Book of Late Pannang Bhushan Tiwari to the office of the Accountant General, Bihar, Patna, for grant of family pension to the petitioner."

Considering the aforesaid facts and circumstances, the petitioner is granted liberty to make/file an appropriate representation before the respondent no. 3. i.e., the Accountant General, Bihar, Patna, for redressal of her grievance, if any. If any such representation is made/filed by the petitioner before the respondent no. 3 i.e., the Accountant General, Bihar, Patna, the respondent no. 3 i.e., the Accountant General, Bihar, Patna, shall consider the representation of the petitioner and pass an appropriate order, in accordance with law, taking the note of the Letter No. 123 dated 20.01.2020, within a period of two months, from the date of making/filing of such representation.
