2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 448, 325, 307, 354, 379, 504, 506 and 34 of the Indian Penal Code.

3. As per prosecution case, this petitioner, along with other co-accused persons, is alleged to have assaulted the informant by means of iron rod.

4. It is submitted by learned counsel appearing on behalf of the petitioner that due to land dispute between the parties, some altercation took place which led to simple maarpeet in between the parties. It is further submitted that this case is counterblast to Aungari P.S. Case No. 61 of 2022 which was

Patna High Court CR. MISC. No.82602 of 2023(2) dt.18-01-2024 2/2 lodged earlier in point of time by the father of the petitioner against the informant and others. It is lastly submitted that though there is specific allegation of assault against this petitioner, but there is no injury report to support the same. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail.

6. Considering the aforesaid facts and circumstances, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda, in connection with Aungari (Pirbigha) P.S. Case No.62 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
