2. Petitioner seeks regular bail in connection with Digha P.S. Case No. 703/ 2024 dated 02.10.2024 registered for the offence(s) punishable under Section(s) 351(2), 352, 109 and 3(5) of the BNS, 2023 and Section 27 of the Arms Act.
3. The main submissions advanced by learned counsel for the petitioner are that there is no serious allegation against the petitioner and as per the FIR, he simply instigated his son to fire at the informant, though, the petitioner's son fired but no one sustained any firearm injury and in the present time, good relation has been established in between both the parties and in
Patna High Court CR. MISC. No.83106 of 2024(2) dt.04-12-2024 2/2 this regard, Annexure-P/2, compromise petition, is relevant. It is further submitted that petitioner has been languishing in jail since 03.10.2024 having fair and clean antecedent and investigation has been completed against him.
4. Learned APP appearing for the State opposes the bail prayer.
5. Considering the above submissions and mainly the petitioner's fair and clean antecedent, nature of allegation and completion of investigation against him, this court is inclined to accept his bail prayer. Accordingly, let the petitioner namedabove be released on bail in connection with Digha P.S. Case No. 703/ 2024 on furnishing bail bond of Rs.20,000/-( Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
