Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Bikramganj PS Excise Case No. 18 of 2003 registered for the offences punishable under Section 47A of the Excise Prohibition, Excise Amendment Act 1915.

Learned APP, at the outset, submits that the case is of the year 2003 and NBW was already issued in the year 2005 and now the petitioner at his leisure is moving seeking anticipatory bail.

Considering the submission made by learned APP, the Court is not inclined to extend the privilege of anticipatory

Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
