The petitioner, in the present case, is seeking regular bail in connection with Jakkanpur P.S. Case No. 383 of 2017, registered for offence alleged under Section 379 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., however it appears that he was caught with the stolen motorcycle on the alleged date of occurrence itself. Submission is that the petitioner is in custody for over six months by now and charge sheet has already been submitted. It is also submitted that the petitioner has no criminal antecedent. Learned APP for the State is present.

Patna High Court Cr.Misc. No.32203 of 2018 (2) dt.12-06-2018 Considering the fact that the petitioner is in custody for over six months and has got no criminal antecedents, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge-I-cum-Additional Chief Judicial Magistrate, Patna in connection with Jakkanpur P.S. Case No. 383 of 2017, subject to the conditions U/S 437(3) Cr.P.C.
