The petitioner is in custody in connection with Karpi P.S. Case No. 63 of 2018 (Excise Case No.-451 of 2018) for the offence under Section 30 (a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He submits that the seizure list was prepared without any independent witness. The witnesses are all the police persons. Counsel for the petitioner further submits that the petitioner is in custody since 07.05.2018.

Considering the fact that the petitioner has no criminal
