Petitioner is apprehending his arrest in connection with Bagwan Bazar P.S.Case No.348 of 2019 , registered for offences punishable under Sections 394 of the Indian Penal Code. As per FIR, some miscreants throwing chilly power snatched Rs.6,10,000/- from the informant. Petitioner is not named in the FIR and later on two persons were arrested and on their confession, there is recovery of Rs.01 lac and they disclosed the name of the petitioner . Apart from that he is accused in one more case.

Submission of the learned counsel for the petitioner is that even in the confession, they have accepted that they have committed the offence and the petitioner has been named

Patna High Court CR. MISC. No.71432 of 2019(2) dt.08-11-2019 2/2 only as an associate and further submission is that the petitioner has enmity with the co-accused, who has confessed the guilt and he has falsely implicated the petitioner. Heard learned A.P.P. also.

Having heard both sides and considering the bovae fact, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Saran at Chapra in connection with Bhagwan Bazar P.S.Case No.348 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
