JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 25-10-2018 Learned counsel for the petitioner prays for two week's time to remove the defects except defect no. 15 (1). It is submitted that the defect no. 15 (1) requires certified copy of entire criminal proceeding whereas the petitioner has moved this Court for quashing of the FIR presently and the criminal proceeding has yet to begin.

In the aforesaid view of the matter, the defect no. 15(1) shall be considered at the time of Admission. At this stage, learned counsel for the petitioner submits that he may be allowed to convert this application in a criminal writ.

He is permitted to do so within two weeks, failing which this application shall stand rejected without further reference to a Bench.
