Petitioner seeks bail in a case registered for the offences punishable under Section 376 of the Indian Penal Code and Section 4 and 8 of the Protection of Children from Sexual Offenses Act, 2012.

Allegation in the FIR is that the petitioner allegedly ravished to the informant.

Learned counsel for the petitioner submits that father of the informant had lodged a case alleging therein that the informant was abducted by the named accused persons (not this petitioner). He further submits that vide Annexure-3, the informant, in her statement under Section 164 Cr.P.C. dated 21.07.2017, has stated that she has voluntarily left her house along

Patna High Court Cr.Misc. No.32567 of 2018 (2) dt.25-06-2018 2/2 with one Sugga Kumar Chaudhary as they were in love and she has already married with Sugga Kumar Chaudhary. Vide Annexure-5, she has filed a petition before the court below that just to pressurize for marriage, the present false case has been lodged.

Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Amdabad Police Station Case No. 16 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
