ANJANA MISHRA ORAL ORDER 03-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 24.05.2019, in connection with Naubatpur P.S. Case No. 314 of 2019 for the offences under Sections 363 and 366(a) of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner and the girl appears to have eloped but, subsequently, on her recovery the victim girl has a given statement which is contrary thereto and the petitioner has been taken into custody. It is further submitted that even if all the allegations as narrated in the statement under Section 164 Cr.P.C. is considered, there is no allegation against the petitioner of having committed any sexual

It is further submitted that the petitioner has already been in custody for more than six months and, therefore, may be extended the privilege of bail. Learned counsel for the petitioner further submits that the petitioner will cooperate in further investigation and be present during the course of trial.
Considering the aforementioned facts and circumstances, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Danapur, in connection with Naubatpur P.S.
