2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 34 of the Indian Penal Code read with Section 4 of the Dowry Prohibition Act.
3. Petitioner, who is husband of opposite party no2., is said to have ousted the opposite party no.2 from her matrimonial home in association of his family members over the dowry demand.

Vide earlier order dated 28.04.2025, the matter was sent to the Patna High Court, Mediation Center for reaching an amicable settlement between the parties and the mediation report would show that the issue between the parties have been resolved by way of Memorandum of Agreement between the parties dated 18.06.2025 in Mediation Proceeding No.640 of 2025. It has been agreed between the parties that an amount of Rs.5,00,000/- would be paid by the petitioner to the O.P. No.2, which would be the full and final settlement of all disputes between the parties. The said amount has been agreed to be paid in two equal installments, the first installment of Rs.2,50,000/- would be paid on or before 18.09.2025 and the second installment of Rs.2,50,000/- on or before 18.12.2025 or on the date of disposal/withdrawal of the present case.
5. Learned counsel appearing for the O.P. No.2 does not dispute the memorandum of agreement which has been reached between the parties.
6. In view of the same, let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on provisional bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned
Patna High Court CR. MISC. No.81920 of 2024(4) dt.25-06-2025 3/3 SDJM, Araria, in connection with Mahila P.S. Case No.41 of 2024 till 18.09.2025 subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482
(2) of the B.N.S.S., 2023 and subject to the further condition that the petitioner shall co-operate in the investigation/trial.
7. It is, however, expected that the parties would strictly adhere to the terms and conditions of the settlement. In such view of the settlement and upon proof of receipt of payment of the first installment of Rs.2,50,000/- by the petitioner to the O.P. No.2, the provisional bail shall stand confirmed by the Court below.
