2. Petitioner apprehends his arrest in connection with Manjhi P.S. Case No. 89 of 2018 dated 26.04.2018, registered for the offence punishable u/s 272, 273, 188, 420 of the IPC and Sections 30, 30(a) & 38 of the Bihar Prohibition and Excise Act, pending in the court of learned 2nd Exclusive Special Excise Judge, Saran at Chapra.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if petitioner surrenders before the learned

No.117 of 2024(2) dt.07-02-2024 2/2 Court below within six weeks from today and seeks regular bail, the learned Court below shall pass order on the same day in accordance with law without being prejudiced by this order considering the fact that similarly situated co-accused persons have been granted anticipatory bail.
