2.The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.

3. The case of the prosecution is that while the informant alongwith his friend Sonu Kumar were returning in night from Mina Bazar, Cherki on 28.06.2024, suddenly 3-4 miscreants attacked him from behind due to which the infomant and his friend fell down from his bike. It is further alleged that miscreants snatched mobile phone, smart watch and other items on the gun point.

4.Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.82685 of 2024(3) dt.30-01-2025 2/2 petitioner is innocent and has committed no offence. He has falsely been implicated in this case. During investigation this petitioner has given his confessional statement in which he has stated that he is a bike mechanic and he dismantles the good parts of the stolen bikes and sells it to the customers. There is nothing except the confessional statement of the petitioner against him and nothing has been recovered from his possession. The petitioner has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 15.09.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6.Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Gurua P.S. Case No. 219 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Sherghati, Gaya.
