JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 14-06-2018 Heard learned counsel for the petitioner, learned counsel for the informant as also the learned APP for the State. The petitioner, in the present case, is seeking regular bail in connection with Ara Nawada P.S. Case No. 385 of 2017, registered for offences alleged under Section 420/34 of the Indian Penal Code.

It is submitted on behalf of the petitioner that so far as the petitioner is concerned, he is not named in the F.I.R, his name has transpired in course of investigation saying that a sum of Rs. 40,000/- has been transferred to his account from the account of named accused Hewanti Devi. It is submitted that without prejudice the petitioner is ready to transfer Rs.40,000/- to the account of the informant.

Learned counsel has placed before this Court a copy of the order dated 04.6.2018 passed in Cr. Misc. No.32831 of 2018

Patna High Court Cr.Misc. No.32736 of 2018 (2) dt.14-06-2018 whereunder the two petitioners including Hewanti Devi has been granted bail by a learned Co-ordinate Bench of this Court as the co-accused Hewanti Devi agreed to transfer the amount of Rs.3,20,000/- in favour of the informant.

Learned counsel for the informant as well as learned APP for the State are present.

Keeping in view the submission whereunder the petitioner is without prejudice ready to transfer an amount of Rs.40,000/- in the account of the informant, let the petitioner above name be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nawada P.S. Case No. 385 of 2017, subject to the conditions U/S 437(3) Cr.P.C. and subject to further that within 15 days from the date of his release on bail the petitioner shall ensure transfer of Rs.40,000/- from his account to the account of the informant in terms of his own submission but without any prejudice subject to result of the case.
