2. The petitioner seeks regular bail in connection with Khushrupur P.S. Case No. 330 of 2022 for the offences registered under Sections 302/34 of the Indian Penal Code and Section 27 of Arms Act.
3. As per prosecution case, F.I.R. has been lodged against 20 named accused persons including the petitioner. Specific allegation of firing is against Rajendra Prasad @ Baudhu who fired on the head of the mother of informant and co-accused Bablu Singh, S/o Sh. Suresh Singh who fired on the head of the father of informant due to which they died. The sister of informant was injured in her stomach by the firing of co-accused Mantu Kumar. The general allegation made against the petitioner that he also fired.

4. Learned counsel for the petitioner submits that petitioner is innocent. He has falsely been implicated in this case. There is allegation against him that he fired causing no injury to anyone. It is further submitted that petitioner has voluntarily surrendered in this case on 09.06.2023 and since then he is in jail custody. He has no criminal antecedent. Similarly situated coaccused persons, namely, Suresh Singh and Rana Singh @ Ranjeet Kumar have been granted bail by a co-ordinate Bench of this Court, vide order dated 10.05.2023 passed in Cr. Misc. No. 16187 of 2023 and order dated 24.06.2023 passed in Cr. Misc. No. 35740 of 2023 respectively.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.
6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court where the case is pending in connection with Khushrupur P.S. Case No. 330 of 2022.
