This application, for grant of anticipatory bail, arises out of Bihra Police Station Case No. 08 of 2018, disclosing offences under Sections 304(B), 201/34 of the Indian Penal Code.
Learned counsel for the petitioners has submitted the petitioners, who are of clean antecedent, are innocent and have not committed any offence. In fact, the petitioners happen to be close relative of the husband of the deceased and they have no concern with the alleged occurrence and the husband of the deceased is in custody. Moreover, several co-accused, having
Patna High Court Cr.Misc. No.32702 of 2018 (2) dt.06-06-2018 more of less similar allegation have already been granted anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 29192 of 2018. Hence, the petitioners deserve the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Bihra Police Station Case No. 8 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
