Petitioners seek bail in a case registered for the offences punishable under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act, 2016.

As per the allegation in the FIR, total of about 500 litres of illicit liquor was recovered from the Bolero vehicle which was being driven by the petitioner no. 2. It is submitted by learned counsel for the petitioners that no recovery as alleged has taken place from the vehicle of the petitioners of which the petitioner no. 2 is only a driver and the petitioner no. 1 is a friend of the petitioner no. 2. They are in

Patna High Court CR. MISC. No.72114 of 2019(2) dt.20-11-2019 2/2 custody since 27.09.2019 and have no criminal antecedent. Having heard learned counsel for the parties and having considered the submissions as made above, the Court is inclined to grant bail to the petitioners.

Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Rohtas, Sasaram in connection with Karakat Police Station Case No. 251 of 2019.
