2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 354A, 385, 504 and 506 of the Indian Penal Code.

3. The case of the prosecution is that on the date of alleged occurrence, informant's minor daughter (victim) was present in her shop, accused Anil Kumar (petitioner) arrived and purchased Guthka, Cigarette etc., thereafter, accused took the

Patna High Court CR. MISC. No.81851 of 2024(4) dt.29-01-2025 2/3 advantage of victim's loneliness, hold her hand and dragged her out of her shop and also teased her. When victim shouted for help, people arrived and the petitioner ran away.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is also submitted that in investigation, the victim has given her statement under Section 164 of the Cr.P.C. and has stated that the petitioner started pulling the hand of the victim. It is also stated that the victim is a minor girl. It is further submitted that the petitioner is languishing in judicial custody since 21.06.2024.

5. Learned APP appearing for the state and learned counsel for the informant have opposed the prayer of regular bail and submitted that petitioner is having criminal antecedent of one case.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with POCSO Case No. 41 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of
