Petitioner, already in custody, seeks bail in connection with Rupaspur P.S. Case No.195 of 2015, registered under Section 394 of the Indian Penal Code.

It is a case of looting motorcycle and the petitioner during investigation was apprehended and confessed his involvement in the occurrence.

Learned counsel for the petitioner submits that except the confessional statement made before the police, there is no other material, neither the motorcycle was recovered from possession of the petitioner nor put on TIP and has been in custody in this case for last two years.

Having considered the aforesaid facts and

No.33611 of 2018(4) dt.06-08-2018 2/2 circumstances as well as the period of custody, petitioner Sushant Kumar @ Raj Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Danapur in connection with Rupaspur P.S. Case No.195 of 2015.
