JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-03-2020 The petitioner, who is in custody since 09.08.2019, seeks bail in connection with Rajnagar P.S. Case No. 207 of 2019, dated 26.07.2019, instituted for the offences under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

It has been submitted on behalf of the petitioner that one of the nephews of the informant informed him that the deceased was shot at by three persons from behind, leading to his death.

The petitioner has neither been named in the F.I.R. nor any suspicion has been raised against him. His name has transpired only in the confession of a coaccused person namely Afzal Ali who has been granted bail by the court below.

No.73679 of 2019(3) dt.17-03-2020 2/2 It has also been pointed out to this Court that the petitioner was earlier made accused in eleven cases, out of which he has been acquitted in three cases. In rest of the eight cases, the petitioner is on bail. Considering the nature of of the accusation against the petitioner, which is primarily based on confession of a co-accused, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM 1st , Madhubani in connection with Rajnagar P.S. Case No. 207 of 2019.

The application stands allowed.
