Petitioner, already in custody, seeks bail in connection with Bihta PS Case No.714 of 2017 registered under Sections 25(1-B)A/26/35 of the Arms Act.

Earlier the prayer of bail of the petitioner was rejected by the Court vide order dated 07.02.2018 passed in Cr. Misc. No.7253 of 2018 with a liberty to renew the prayer of bail after two months of framing of charge. It appears that still charge has not been framed as some of the accused are not appearing. The trial court is directed to exhaust all steps to procure appearance of other co-accused. Thereafter in case of their non-appearance separate the case of the petitioner in accordance with law and frame charge.
