The petitioner apprehends his arrest in connection with Runni Saidpur P.S. Case No. 388 of 2017 registered under Sections 406 and 420 of the Indian Penal Code. The accusation is that informant, Lokesh Kumar Singh, was engaged by the petitioner to perform the Orchestra programme on payment of Rs.28,000/-. At that time, petitioner paid Rs.5,000/- as advance with assurance to pay Rs.23,000/- after performing the Orchestra pragrame, but after performing Orchestra programme, petitioner did not pay the remuneration. On 25.04.2007, informant demanded remaining amount of Rs.23,000/-, but the petitioner did not take any heed. Thereafter,

Patna High Court Cr.Misc. No.33095 of 2018(2) dt.14-06-2018 2/2 on 05.07.2017, petitioner along with two persons came and opened fire and also threatened him of dire consequences. Learned counsel for the petitioner submits that it would appear from the complaint petition, which is the basis of the F.I.R., that there was dispute for non-payment of remuneration in between the petitioner and informant and the same has been settled on payment of money by the petitioner. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Runni Saidpur P.S. Case No. 388 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
