JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-12-2019 This is an application for grant of anticipatory bail in connection with Forbesganj P. S. Case No. 197 of 2014, G.R. No. 1164 of 2014 disclosing offences under Sections 409, 420 of the Indian Penal Code and Section 134 of the R.P.Act. Allegation against the petitioner is that petitioner is a government teacher and he was deputed to perform his duty in Lok Sabha Election, 2014 after receiving the letter and advance money he has not participated and performed his duty in Lok Sabha Election and does not return the money. Submission of learned counsel for the petitioner is that the marriage date of the petitioner has been declared earlier at the time of Lok Sabha Election and he has informed the concerning officer about that and return the advance money.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No. 197 of 2014, G.R. No. 1164 of 2014, subject to the condition laid down under Section 438(2) Cr.P.C. (Vinod Kumar Sinha, J) Rahul Mishra/- U T
