2. The petitioner has prayed for bail in a case registered for the offence punishable under section 304/34 of the Indian Penal Code.

3. As per allegation in the FIR, petitioner had fenced his agricultural field with naked electric wire to protect his vegetable cultivation. On the alleged date of occurrence, informant's son was crossing through his field and suddenly he came into contact with naked electric wire and he died due to electrocution.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Wife of

No.81874 of 2023(3) dt.02-02-2024 2/2 the present petitioner has also filed Surajgarha PS Case No. 320 of 2023 against the informant and others for assaulting her husband mercilessly by them. Allegation of fencing to the agricultural field with electric wire is totally false and fabricated. Petitioner has got no criminal antecedent and languishing in judicial custody since 8.9.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Lakhisarai in connection with Surajgarha P.S. Case No. 318 of 2023.
