The petitioner, in the present case, is seeking regular bail in connection with Ismailpur P.S. Case No.83 of 2014, registered for offences alleged under Section 414 of the Indian Penal Code and Sections 25(1-A)(1-B)a, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that even though the allegation is that in course of raid police party has found large number of arms and ammunitions from the house of this petitioner, a seizure list would show that there is no independent witness. Learned counsel further submits that the house in question does not belong to the petitioner.
On the other hand, learned APP for the State has opposed
Patna High Court Cr.Misc. No.37229 of 2018 (2) dt.29-06-2018 the prayer for bail pointing out to this Court that the case is of the year 2014, the petitioner has got criminal antecedent and from the seizure list it would appear that huge quantity of arms and ammunitions have been recovered from the house in course of raid.
Considering the nature of the allegations whereunder it is stated that huge quantity of arms and ammunitions have been recovered from the house of petitioner and that this case is of the year 2014 in which the petitioner has been arrested only recently in the month of January, 2018, I am not inclined to grant regular bail to the petitioner. Accordingly, his prayer for bail in connection with Ismailpur P.S. Case No.83 of 2014 pending in the court of learned Sub-Divisional Judicial Magistrate, Naugachia is rejected.
Let the trial be expedited.
