Petitioners apprehend their arrest in connection with Purnahia P.S. Case No. 18 of 2018, registered for the offences punishable under Sections 366A and 363/34 of the Indian Penal Code.
The informant, Kamlesh Chaudhary alleged that his daughter Anupama Kumari, aged about 17 years has been enticed away by petitioners and other co-accused persons and after lodging that case one co-accused Satrughan Gupta made contact with the informant on mobile and gave threat to the informant not to search the victim otherwise he would be killed and then the informant went to the house of the accused from where he was ousted and no trace came out.
Patna High Court Cr.Misc. No.33563 of 2018 (2) dt.07-06-2018 2/2 The learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that the date of occurrence is 07.02.2018 and the F.I.R. has been lodged after one month on 08.03.2018 without explaining the reason of delayed F.I.R. the victim girl being major on her own sweet-will married with the accused Satrughan Kumar and both were leading their conjugal life in Sitamarhi. The victim girl filed a petition before the Sub-Divisional Judicial Magistrate, Sheohar and has also made an application before the Superintendent of Police and S.H.O. with regard to the wrong institution of the present case by her father.
Considering the facts and circumstances of the case, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Purnahia P.S. Case No. 18 of 2018, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
