The petitioner is seeking regular bail in Rampur P.S. Case No. 116/2015, registered under Section 392 of the Indian Penal Code.

Learned counsel submits that the petitioner has been taken on remand in the present case when he was arrested in connection with Rampur P.S. Case No. 106/2015 under Section 25(1-b)a of the Arms Act. Learned counsel submits that the petitioner is not named in the FIR, he is in custody in connection with this case since 16.04.2018 and till date no T.I.P has been conducted to establish the identity of the petitioner with the alleged occurrence. Learned counsel further submits that no incriminating article has been recovered from

Patna High Court Cr.Misc. No.33834 of 2018 (2) dt.14-06-2018 2/2 the possession of the petitioner and he has been involved in the present case only on the basis of mere suspicion. Learned A.P.P for the State is present.

Considering the facts and circumstance of the case wherein the petitioner is not said to have been put on T.I.P and has been taken on remand in connection with this case, even as no incriminating article has been recovered from his possession, I would direct released of the petitioner. Let the petitioner, named above, be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Rampur P.S. Case No. 116/2015, subject to the conditions as laid down under Section 437(3) Cr.P.C.
