The petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code and Section 27 of the Arms Act.
Four motorcycle borne criminals brandishing pistol in their hands resorted firing and looted away Rs.2,33,299/- from the cash counter of the gas agency.
It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. There is nothing cogent on record indicating the complicity of the petitioner in the occurrence barring confessional statement made by co-accused Krishna Singh and Shubham Kumar recorded by the police, which has no evidentiary value in the
Patna High Court CR. MISC. No.73976 of 2019(2) dt.11-12-2019 2/2 eye of law. No incriminating article has been recovered from conscious physical possession of the petitioner. Co-accused, namely, Krishna Singh has been enlarged on bail by a coordinate bench of this court vide order dated 18.10.2019 passed in Cr. Misc. No. 58807 of 2019. The petitioner has been languishing in custody since 16.09.2019.
Learned APP for the State opposed the bail petition.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No.130 of 2018.
