The petitioner has filed the instant application for grant of bail in a case registered for the offence under section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, As per the allegation in the FIR, 1058.4 litres of IMFL is said to have been recovered from a truck parked on the road side near the vegetable market. It is further alleged that two persons managed to escape, one of whom i.e. the petitioner was identified by the choukidar.

It is submitted by learned counsel for the petitioner that the allegation against the petitioner is false and concocted, no recovery as alleged has taken place from the possession of the petitioner, he has no concern either with the seized article or the vehicle in question, he is in custody since 06.10.2019 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-cum-Special Judge, Excise, Rohtas at Sasaram in connection with Bikramganj P.S. Case No. 473 of 2019.
