1. Heard learned counsel for the petitioner and learned APP for the State
2. The petitioner has preferred this application for grant of regular bail in connection with Hasanganj P.S. Case no. 165 of 2022, registered under sections 498A and 494 of the Indian Penal Code.
3. As per the prosecution case, the informant states that for non-fulfillment of demand of Rs. 1,00,000/-, she was tortured assaulted and her husband, the petitioner herein also solemnized another marriage.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. The
Patna High Court CR. MISC. No.83255 of 2023(2) dt.10-01-2024 2/2 allegations are false and concocted. The petitioner is in custody since 11.8.2023 and investigation in the case has concluded.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R, the petitioner having remained in custody for 5 months since 11.8.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Hasanganj P.S. Case no. 165 of 2022, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Katihar.
