The petitioner apprehends his arrest in Sheikhpura Mahila P.S. Case No. 13 of 2021 registered for the offence punishable under Sections 498(A), 494, 341, 323, 504, 506/34 of the Indian Penal Code.

The prosecution case in short, is that after death of informant's first husband, she got married to Shravan Kumar. Aftrer marriage, he got five decimals of land of informant in his name. Shravan Kumar's mother used to tell the informant to transfer Sheikhpura house in Shravan's name, otherwise he would marry Shravan for the second time and in consequence

Patna High Court CR. MISC. No.83420 of 2023(2) dt.18-01-2024 2/3 thereof, all the accused persons ousted her from the house by assaulting her.

Learned counsel for the petitioner has submitted that the petitioner has got clean antecedent and he has falsely been implicated in this case. As a matter of fact, the informant was married to late Mohan Paswan and she was an accused in the murder case of her previous husband Mohan Paswan, in which, she was sentenced to life imprisonment. Again, she married to one Mahendra Prasad and she filed a case against him also. The petitioner has been made accused in the present case as because he is looking after the case of the informant. It has further been submitted that she has also filed Sarmera P.S. Case No. 79 of 2021 against the petitioner under Section 354A of the Indian Penal Code.

Learned APP appearing for the state opposed the prayer for anticipatory bail.

Considering the above-mentioned facts and circumstances of the case, let the petitioner named above, in the event of his arrest or surrender within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura in
