The petitioner seeks bail in connection with Dehri Town P.S. Case No. 644 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that there is recovery of 390.8 liters of country made liquor from the Aangan of the petitioner. He further submits that the petitioner is in jail custody since 17.09.2019 and further submits that the petitioner has got no any criminal antecedent mentioned in paragraph-3 of the petition.

In the facts and circumstances of the case, I am inclined to grant bail to the petitioner, subject to deposit of

Patna High Court CR. MISC. No.72474 of 2019(2) dt.25-11-2019 2/2 Rs.15,000/- in the court below/Nazarat. Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional District and Sessions Judge-cum-Special Judge (Excise), Rohtas at Sasaram in connection with Dehri Town P.S. Case No. 644 of 2019. Such deposit of Rs.15,000/- shall abide by the outcome of the criminal case.
