In this case, the petitioner is apprehending his arrest in connection with Karakat P.S. Case No. 227 of 2019 registered for offences under sections 302/34 of the Indian Penal Code.

As per prosecution case, the petitioner and his family members jointly assaulted the victim, led to his death. In paragraph nos. 7, 8, 9, 29, 35, 36, 37 and 38 of the Case Diary, there is a statement against the petitioner to have assaulted with rod which led to death of the deceased. Looking to the entire facts and circumstances of the case as also there being specific allegation of assault against

Patna High Court CR. MISC. No.72643 of 2019(5) dt.24-07-2020 2/2 the petitioner, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, the prayer for bail of the petitioner, above named, is rejected.

If the petitioner surrenders before the court below within a period of eight weeks from today and makes a prayer for bail, the court below, without being prejudiced by this order, will pass orders in accordance with law.
