2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 326, 307, 302, 34 of the Indian Penal Code and Section 27 of Arms Act.

3. According to FIR, it is alleged that on 3.5.2023, the accused persons including the petitioner caught the brother of the informant and co-accused Ravi Kumar Singh stabbed him by means knife due to which he died.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. From perusal of FIR, no specific allegation of assaulting against this petitioner rather the same is attributed to co-accused Ravi Kumar Singh who stabbed

Patna High Court CR. MISC. No.83636 of 2023(2) dt.04-01-2024 2/2 in the chest of the deceased by means of knife due to which he died. It is also submitted that there is only one stab injury on the body of the deceased which is apparent from postmortem report vide Anneuxre-P/2. General and omnibus allegation against this petitioner. He has got no criminal antecedent and languishing in judicial custody since 8.6.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge him on bail. The above named petitioner is directed to be released on bail in connection with Kahalgaon (Ghogha) P.S. Case No. 648 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-XIII, Bhagalpur.
