The petitioner is apprehending his arrest in connection with Town P.S.Case No.549 of 2017 registered for offences punishable under Sections 419 and 420/34 of the Indian Penal Code. Allegation against the petitioner is that at his place, another person was appearing in the examination and he was arrested. Submission of the learned counsel for the petitioner is he has submitted that the petitioner has falsely been implicated in this case and as a matter of fact another accused was appearing without permission of the peititoner.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant

Patna High Court Cr.Misc. No.33722 of 2018 (4) dt.10-08-2018 2/2 anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.

With the aforesaid observation, this application is dismissed.
