2. The accused-petitioners, not named in the F.I.R., are apprehending their arrest in connection with Ladaniya P.S. Case No. 107 of 2025 registered for the offences punishable under Sections 318(4), 64 of the Bhartiya Nyay Sanhita, 2023 (in short, the 'B.N.S.').
3. As per FIR, knowing the relationship of informant with co-accused Vikash Kumar, she was ousted from her matrimonial home whereafter she started to live with coaccused Vikash Kumar and when on 27.02.2025, the
Patna High Court CR. MISC. No.79885 of 2025(2) dt.19-11-2025 2/3 informant was in process to solemnize marriage with coaccused Vikash Kumar, on pretext of purchasing the marriage related items, he left the informant without any information.
4. Learned counsel appearing on behalf of the petitioners submitted that informant is a married lady and when she was ousted from her matrimonial home, she started to live in live-in-relationship with co-accused Vikash Kumar with whom she was already in love prior to her marriage.
5. It is submitted that petitioner no. 1 is the mother of co-accused Vikash Kumar, whereas petitioner nos. 2 and 3 are brothers. It is submitted that since petitioners are the family members of co-accused Vikash Kumar, they have been falsely implicated in this case. Petitioners have got no criminal antecedent.
6. Learned A.P.P. for the State opposes the prayer of anticipatory bail of the petitioners.
7. In view of aforesaid factual submission and by taking note of the fact as petitioners implicated in this case only for the reason that they are mother and brothers of coaccused Vikash Kumar, accordingly, above-named petitioners,
Patna High Court CR. MISC. No.79885 of 2025(2) dt.19-11-2025 3/3 in the event of their arrest/surrender within a period of four weeks from this order, are directed to be enlarged on bail on furnishing of bail bond of Rs.10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Madhubani/concerned court in connection with Ladaniya P.S. Case No. 107 of 2025, subject to the conditions as laid down under Section 438(2) of the Cr.P.C/Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita (in short "B.N.S.S.").
