The petitioner is apprehending his arrest in connection with Saran Town P.S. Case No.481 of 2019 registered for the offence punishable under Sections 25(1-b) a, 29 and 30 of the Arms Act.
Learned counsel for the petitioner submits that at best, even if the provisions of Section 29 of the Arms Act are invoked as against the present petitioner, he shall be liable to fine and imprisonment for six months, which in any case the petitioner would explain as and when required. Patna High Court CR. MISC. No.76247 of 2019(2) dt.28-11-2019 2/2 reading of the F.I.R. itself, raid was conducted behind his back and it can be said that actually the arms in question was recovered from another house and not from the house of the petitioner.
Considering the aforementioned facts and circumstances and the nature of allegations, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, in connection with Saran Town P.S.
