Petitioner seeks regular bail in connection with Khirhar P.S. Case No.74 of 2019, corresponding to G.R. No.1908 of 2019, for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

The allegation against the petitioner is that the motorcycle of the petitioner was intercepted and police recovered a total quantity of 21.300 litres of Nepali liquor from the said motorcycle.

Learned counsel for the petitioner submits that the petitioner is not the owner of the motorcycle, as stated in para 7 of this petition and the motorcycle was being driven by the petitioner and one pillion rider was carrying a bag containing

Patna High Court CR. MISC. No.72547 of 2019(2) dt.04-12-2019 2/2 illicit liquor. Learned counsel further submits that the petitioner has got no criminal antecedent and he is in custody since 08.10.2019.

Having regard to the submissions made by the parties and taking into consideration the fact that the petitioner has got no criminal antecedent and the he is in custody since 08.10.2019, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, 2nd-cum-Special Judge, Excise Act, Madhubani, in connection with Khirhar P.S.
