The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 307, 120(B) of the Indian Penal Code and Section 27 of the Arms Act. As per allegation in the FIR, while the informant, being a doctor was going to discharge his duty, one miscreant reached near his vehicle and opened fire due to which he sustained head injuries. Informant has strong suspicion that under conspiracy, Dr. Aash Bhushan has hired persons to kill him.

No.82983 of 2023(3) dt.19-01-2024 2/3 It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. Neither the petitioner was named in F.I.R. nor he has any concern with the co-accused persons. During investigation, it has came in light that specific allegation of firing is attributed against Munchun Paswan and Dhiraj Singh. The name of petitioner sprang up in this case on the basis of his own confessional statement. Moreover, the petitioner is languishing in judicial custody since 21.07.2023. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Sitamarhi P.S. Case No. 297 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees
