The petitioner seeks bail in connection with Babubarhi P.S. Case No. 166 of 2019, registered under Sections 272, 273 and 34 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that in course of patrolling duty, one tempo, which was being driven by Md. Ashraf, was stopped. On search, 311.700 liters of Nepali liquor, kept in different bottles, recovered. On query, he disclosed that on the instruction of Shambhu Singh the seized bottles of liquor were to be supplied to the petitioner.

Submission is that the petitioner has no criminal antecedent and is in custody since 05.10.2019. Having regard to the facts and circumstances of the

No.72688 of 2019(2) dt.11-12-2019 2/2 case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Babubarhi P.S. Case No. 166 of 2019 to the satisfaction of the Additional District & Sessions Judge II-cum-Special Judge, Excise Act, Madhubani.
