====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Excise Case No. 143 of 2018 for the offence under Sections 30(a) and 38(i) of the Bihar Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. The petitioner is in custody since 09.05.2018 in connection with seizure of 100 litres of foreign liquor. He submits that the alleged liquor was sized from the toilet and not from the conscious possession or inside the house of the petitioner.
Considering the aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like
Patna High Court Cr.Misc. No.36391 of 2018 (2) dt.28-06-2018 2/2 amount each to the satisfaction of Additional Sessions Judge-VIcum-Excise Court, Samastipur in connection with Excise Case No. 143 of 2018 with the condition that the bailors should be the family members.
