The petitioner seeks bail in Shyampur Bhatha P.S.Case No.18 of 2018 instituted for the offence under Section 395 of the Indian Penal Code. As per the F.I.R. six miscreants intercepted the informant and snatched Rs.2,20,000/- as well as his purse containing driving license, pan card, Adhar card and mobile from his possession. It has been submitted that during investigation one co-accused Anad Mohan @ Rajesh Kumar was arrested by the police who disclosed the name of this petitioner. The said Anand Mohan has already been granted bail by a coordinate Bench of this Court vide order dated 7.6.2018 passed in Cr. Misc. No.34032 of 2018. The other co-accused have also been allowed bail in Cr.Misc.No.34323/18 and Cr.Misc.No.36079/18. As soon as the petitioner came to know about his involvement in the present case, he suo motu surrendered before the Chief Judicial Magistrate, Sheohar on 15.03.2018. The petitioner has clean antecedent and except disclosure of his name there is nothing against the petitioner.
Patna High Court Cr.Misc. No.37494 of 2018 (3) dt.19-07-2018 2/2 Learned A.P.P. opposed the submissions.
In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Sheohar, in Shyampur Bhatha P.S.Case No.18 of 2018 subject to the conditions that (1) One of the bailors must be a local person having sufficient immovable property within the jurisdiction of the court concerned, (2)The petitioner will not induce any witness or tamper with the evidence. (3) The petitioner shall cooperate in the disposal of the trial and made himself available as and when required by the court and on the event of failure on his part in appearing before the court below on two consecutive dates without showing any genuine reason, the prosecution is free to move for cancellation of his bail.
