The petitioners, in the present case, are seeking regular bail in connection with Special Case No. 3681 of 2018, arising out of Rajeev Nagar P.S. Case No. 111 of 2018, registered for offences alleged under Section 30(A) of Bihar Prohibition and Excise Act, 2016.
It is submitted on behalf of the petitioners that the petitioners are father and son. The house in question stands in the name of another son and the same has been let-out as the petitioners are residing elsewhere. Learned counsel submits that the allegation is that of recovery of 24 sealed bottles each
Patna High Court Cr.Misc. No.34176 of 2018 (2) dt.13-06-2018 containing 750 ml of illicit liquor. The petitioners have no criminal antecedent and they are in custody since 25.04.2018. Learned A.P.P. for the State is present.
Considering the facts and circumstances of the case whereunder the petitioners are said to be residing elsewhere and the house in question stands in the name of another son of petitioner no.2 as also that the house is said to have been let-out, let the petitioners, above named, be enlarged on bail on their furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Special Case No.3681 of 2018, arising out of Rajeev Nagar P.S. Case No.111 of 2018, subject to the conditions under Section 437(3) Cr.P.C. (Rajeev Ranjan Prasad, J) Arvind/- U T
