The petitioner is apprehending arrest in a case registered for the offences punishable under Section 47(a) of the Bihar Excise Act.

The prosecution case is that from the possession of the petitioner, 42 litres of illicit liquor and 70 Kg. of fermented mahua were recovered.

Considering the fact that the FIR was lodged in the year 2011 and the present anticipatory bail application has been filed in the year 2019, this Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected.

No.83791 of 2019(2) dt.18-12-2019 2/2 However, learned Court below may Consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Complaint Case No. 328C-2 of 2011, pending in the Court of learned Addl. District and Sessions Judge-II, Jamui.
