JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-01-2026 Earlier, vide order dated 08.01.2026, this anticipatory bail petition stood dismissed as withdrawn in respect of petitioner no. 1 namely Anand Kumar.

2. Heard learned counsel for the parties.

3. Sole petitioner (i.e. petitioner no. 2) apprehends his arrest in a case registered for the offence under Sections 126(2), 127(2), 115(2), 118(1), 74, 109, 303(2), 352, 351(2), 3(5) of the B.N.S., 2023.

4. It is alleged that all the F.I.R. named accused persons including this petitioner assaulted both sons of informant namely Amit Kumar and Sumit Kumar.

5. Learned counsel for the petitioner submits that as

Patna High Court CR. MISC. No.78144 of 2025(4) dt.28-01-2026 2/2 per F.I.R., specific accusation of assault is against other coaccused persons. So far as this petitioner / Rajendra Mahto is concerned, there is general and omnibus allegation. Case and counter case.

6. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

7. Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of eight weeks from today, let the petitioner namely Rajendra Mahto be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Rosera, District - Samstipur / concerned Court in connection with Bibhutipur P.S. Case No. 52 of 2025, subject to condition as laid down under Section 482 of the B.N.S.S., 2023.
