2. The petitioner has preferred this application for grant of regular bail in connection with Raghopur P.S. Case No. 286 of 2024 dated 19.08.2024 registered for the offences punishable u/ss 317(4), 317(5) and 3(5) of the Bharatiya Nyaya Sanhita and Section 136 of the Electricity Act.
3. As per the prosecution case, on 19.08.2024, the police patrolling team reached near Raghopur Railway Crossing and they noticed that a driver of the pick-up vehicle was attempting to flee on seeing the police party. It is alleged that the driver was apprehended by police. On being asked, he disclosed that the vehicle contained electrical wires which were stolen property. The apprehended person disclosed his name as Nandkishor Yadav (petitioner).

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. It is further submitted that the petitioner is merely a driver who earns his livelihood by transporting goods on a hire basis and he has no concern with the alleged recovery. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 19.08.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Supaul in connection with Raghopur P.S. Case No. 286 of 2024.
7. The application stands allowed.
