The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471 and 120(B) of the Indian Penal Code. The prosecution case as per the written report of Dasrath Prasad Yadav, Inspector, Bihar Home Guard, Lakhisarai submitted to the SHO, Kavaiya police station is to the effect that District Appointment Committee was constituted for the appointment of Home Guard but during the selection process for such appointment, it was found the educational certificates of the petitioner were forged.
It is submitted by learned counsel for the petitioner that no verification of the educational certificate was made from
Patna High Court Cr.Misc. No.37915 of 2018(2) dt.05-07-2018 2/2 Bihar School Examination Board and the petitioner has not been appointed in pursuance to the said selection process. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.
Learned APP submits that the petitioner submitted fake educational certificate for getting the appointment as a constable in Home Guard.
Considering the fact that petitioner was not actually appointed on the basis of the alleged forged certificate and statement has been made in paragraph 3 of the petition that petitioner has no criminal antecedent, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai (Kabaiya) P.S. Case No. 100 of 2018, subject to the conditions laid down in Section 438(2) of the Cr.P.C.
