JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-12-2019 Petitioners seek bail in anticipation of their arrest in connection with Darbhanga Sadar P.S. Case No. 342 of 2019 registered for the offences punishable under Sections 147, 148, 149, 323, 325 and 302 of the Indian Penal Code. As per FIR police got information that a thief was being assaulted by several persons and reached the place and found a person in unconscious condition, who could not disclose anything and police on inquiry got an information that petitioners and several other accused persons brutally assaulted

Submission of learned counsel for the petitioners is that except suspicion there is nothing against them and there is no source of information and there is no eye-witness to the occurrence and all the witnesses are hearsay witnesses. Heard learned APP, who could not controvert the above submission.

In view of above facts and circumstances, let petitioners, in the event of surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga, in connection with Darbhanga Sadar P.S. Case No. 342 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
