The petitioner who is in custody since 24.04.2019 has filed the instant application for grant of bail in connection with Nautan P.S. Case No. 142 of 2019 (District-West Champaran) registered for the offence punishable under sections 376, 511 and 506 of the Indian Penal Code and section 12 of the POCSO Act.

As per the allegation in the FIR, the petitioner is said to have attempted to commit rape on the daughter of the informant.

It is submitted by learned counsel for the petitioner that the petitioner and the informant are neighbours and the petitioner has been falsely implicated for ulterior motive and he

It is submitted that the petitioner is 55 years old having children and grand children and the allegations are preposterous. The application for bail was opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the direct allegation against the petitioner in the F.I.R., this Court is not inclined to grant bail to the petitioner and as such the petitioner's application for bail is rejected.

It further transpires from the order of the court below that charges have been framed in the case on 29.7.2019. Learned court below is directed to expedite the trial. (Partha Sarthy, J) Bibhash/- U T
