====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-03-2020 Heard learned counsel for the petitioner, the learned counsel for the informant and learned Additional Public Prosecutor for the state.

The petitioner seeks bail in connection with Bheldi P.S. Case No. 173 of 2019, registered under Sections 302, 34 and 120B of the Indian Penal Code and 27 of the Arms Act. The accusation is that in the evening of 06.07.2019, Phoolwanti Devi, wife of Sikandar Singh, grand-daughter of Sipahi Singh, co-villager of informant, Ramdev Singh, asked to Chandra Shekhar Singh, younger son of the informant to see off her at Parsa for catching the bus. Thereafter, Chandra Shekhar Singh moved with his motorcycle to see off Phoolwanti Devi at Parsa. Phoolwanti Devi returned in the village and informed that six miscreants shot fire to Chandra Shekhar Singh and they also snatched her ornaments. Informant raised suspicion about

Patna High Court CR. MISC. No.72144 of 2019(3) dt.04-03-2020 2/2 committing of murder of his son, Chandra Shekhar Singh, by Firoz, resident of Patna, he under conspiracy of Phoolwanti Devi and she had love affairs with Firoz.

Submission is that while on investigation police has submitted the charge sheet, but, none has claimed to see the occurrence. Since, the petitioner is the Pattidar of the informant and she is living alone at her house as her husband use to reside outside for livelihood, due to that reason to grab the property the informant lodged the present case. The petitioner, who is a lady, is in custody since 07.07.2019.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Bheldi P.S. Case No. 173 of 2019 to the satisfaction of the Additional Chief Judicial Magistrate, XII, Saran at Chapra. (Rajendra Kumar Mishra, J) Shamshad/- U T
